Terms of Service

These Terms of Service ("Terms") govern your use of the SpecNgn Product Configurator application ("the App") provided by SpecNgn ("we", "us", or "our"). By installing or using the App, you agree to be bound by these Terms.

1. Service Description

SpecNgn is a product configurator application for Shopify stores. The App enables your customers to configure products by selecting materials, fabrics, and options with real-time pricing displayed on your product pages. The App includes a merchant dashboard for managing product configurations, materials, pricing rules, and order tracking.

2. Account and Access

To use the App, you must have an active Shopify store and install the App through the Shopify App Store. During installation, you will create a SpecNgn account with a password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Free Trial

SpecNgn offers a 14-day free trial starting from the date of installation. During the trial period, you have full access to all App features. No payment information is required to start the trial. At the end of the trial period, you may activate a paid subscription to continue using the App.

4. Pricing and Billing

After the free trial, the App is available at $49.99 per month. Billing is processed through Shopify's billing system. The charge will appear on your regular Shopify invoice. You can cancel your subscription at any time by uninstalling the App from your Shopify store.

5. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to the data practices described in the Privacy Policy.

6. Your Data

You retain all ownership rights to your product data, configuration data, and any other content you provide through the App. We do not claim any ownership rights to your data. You grant us a limited license to use your data solely for the purpose of providing the SpecNgn service to you.

7. Acceptable Use

You agree to use the App only for its intended purpose: configuring and selling products through your Shopify store. You agree not to:

  • Attempt to access other merchants' data or systems.
  • Reverse engineer, decompile, or disassemble the App or its components.
  • Use the App to transmit malicious code or interfere with the service.
  • Resell or redistribute access to the App without our written consent.

8. Service Availability

We strive to maintain high availability of the App and the configurator widget on your storefront. However, we do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability. We will provide reasonable notice of planned maintenance when possible.

9. Limitation of Liability

To the maximum extent permitted by law, SpecNgn shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.

10. Termination

You may terminate your use of the App at any time by uninstalling it from your Shopify store. We may terminate or suspend your access to the App if you violate these Terms or if required to do so by law. Upon termination, your data will be handled as described in our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the SpecNgn dashboard. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, United States, without regard to its conflict of law provisions.
